Cohen, Trump's fiercely loyal and pugnacious lawyer, was in Manhattan federal court to ask the judge to limit the ability of federal prosecutors to review documents seized from his offices and home last week as part of a criminal investigation.
Monday's hearing began with an appearance by porn actress Stormy Daniels, who was swarmed by photographers and almost fell as she was hustled into the courthouse, a scene that captured the sensational atmosphere around the case. To restate a point I made earlier, does anyone believe that Hannity would have criticized the feds less, or not at all, for raiding Cohen's office if his own communications hadn't been caught up in the raid?
He was referencing his good friend and former colleague from the "The Daily Show", who was known for his attacks on Fox News and his various feuds with Hannity. They exchanged insults on Twitter, with Hannity calling Kimmel a racist, pervert and "Harvey Weinstein jr." and Kimmel making a gay sexual innuendo in reference to Hannity's apparent love for Trump.
The Russia investigation has frustrated the White House as it has spread to enfold some of Trump's closest confidantes. The Southern District of NY reportedly initiated the Cohen raids after receiving a referral from Mueller, most likely because he uncovered evidence of wrongdoing related to Cohen that fell outside the purview of his investigation into Russia's meddling in the 2016 United States election and whether the Trump campaign colluded with Moscow. "I might have handed him 10 bucks [and said, ] 'I definitely want your attorney-client privilege on this, ' " Hannity said on the radio. Attorneys for Trump and Cohen sought to review the records on the legal clients before they are turned over to prosecutors. "That's not enough under the law". He then went in on Hannity's claims that he thought his discussions with Cohen were private and that they "never involved any matter between me and a third-party".
In a series of tweets on Monday afternoon, Hannity downplayed his relationship with Cohen, saying he merely asked him some legal questions and "Cohen has never represented me in any matter". He bent over backwards to deny the relationship, claiming nothing more than a few harmless chit-chats over real estate.
Legal advice can be considered privileged even if given by a lawyer for free.
Trump's lawyers responded that it was "unreasonable" to expect federal prosecutors to protect the president's rights - thus disputing the Justice Department's position.
In addition to Hannity and Trump, Cohen's other client is former RNC deputy finance chair Elliott Broidy, who enlisted Cohen's services to deliver $1.6 million in hush money to a Playboy Playmate that Broidy (who is married) impregnated.
