'How can you do this on MLK Day?' Trump's ICE deports non-criminal immigrant dad who came to US at age 10

This Family's Heartbreaking Story Reveals the True Human Consequences of Trump's DACA Fight

"It was touch-and-go throughout the Obama administration", but Jorge Garcia had no chance when President Donald Trump started going for the "low-hanging fruit", said Shelley.

They recently checked in with immigration services, and that's when they were told he had to leave. However, because he is 39 years old, he is disqualified from applying for protection under the Deferred Action for Childhood Arrivals (DACA) program.

According to Fox 8, Garcia was brought to the USA illegally when he was 10 years old.

Jorge Garcia was surrounded by his wife and two children shortly before he boarded a plane to Mexico Monday. But because of the Trump administration's immigration crackdown, Garcia was ordered in November to return to Mexico. Garcia, reportedly brought to the U.S. illegally at the age of 10, was said to have paid taxes and had no criminal record, according to supporters.

Help could be on the way for people like Garcia in the form of a new DACA that would extent to older immigrants, but because he was already deported he may not qualify even if that bill eventually passes.

"I feel kind of sad", Garcia said Sunday night, his eyes welling up.

"We've never done anything without the permission from Immigrations".

Cindy Garcia said agents told her that because Jorge Garcia doesn't have a criminal record, he could stay through the Christmas holiday.

"I'm going to be sad because I'm not going to be able to be with them", Garcia said at the table of a friend's home in southwest Detroit during a farewell party for him. Other immigrant advocates and an official with the United Auto Workers joined him at the airport. Diego Bonesatti, legal services director for Michigan United, and others have been fighting for Garcia for years and now will try to get him back.

Garcia and his family tried for month sto get a stay to allow him to remain in the US until the new bills were voted on, but he was denied in recent weeks and given until January 15 to leave.

Cindy and Jorge Garcia met in Detroit and have been married for 15 years, she said. "All they know is that their dad is gone, and they don't know when they're going to see him again". "If you're going to pick someone who's ideal", he would be it.

Garcia's wife, Cindy, spoke out on her husband's deportation, describing the situation as a "nightmare".

"Get to know the facts before you make a judgment", she said.
