Newport News Va. House of Delegates recount now a tie after contested vote changed to Republican candidate

A single vote gives Democrats election win and a tie in Virginias House of Delegates

But after a challenge by Yancey on Wednesday ― around a contested ballot that had previously been uncounted ― a three-judge panel ruled that the ballot would count for the Republican delegate, meaning the race was now down to a tie.

Before the November 7 general election, Virginia Republicans held 66 seats to the Democrats' 34 in the legislature, along with a majority in the state Senate.

Still, as has been widely noted today: this is an object lesson in every vote counting.

Simonds unlikely victory not only marks a victory in her state district but ends 18 years of Republican control of the Virginia state legislature. Republican incumbent David Yancey held a 10-vote lead after Election Day for Virginia's 94th House District.

In a statement Wednesday, Yancey said he was "happy" every vote was counted and was going to allow the Board of Elections to manage the process.

"Today's decision by the court was wrong, and Delegate-elect Shelly Simonds should have been certified the victor".

He said the ballot in question contained a mark for Democrat Shelly Simonds as well as a mark for Republican Del.

For this week's nail-biting recount in Virginia, the State Board of Elections has yet to decide precisely when and through which game of chance the tie will be broken. Simonds' win also makes the next legislative session the first one in almost two decades in which the GOP won't control the House.

"The court declares there is no victor in this election", said Newport News Circuit Court Judge Bryant L. Sugg. At this time, the matter is still with the recount court. The relevant statute states that in the event of a tie, authorities "shall proceed publicly to determine by lot which of the candidates shall be declared elected". Will there be a coin toss?

The new vote total means that Republicans have, for the time being, narrowly avoided losing their slim 49-51 majority in Virginia's House of Delegates. Drawing lots is a insane way to choose a representative.
