Rohingya in India 'Illegal', a National Security Threat, Modi Government Says in Court Affidavit

The decision to deport 40,000 Rohingya Muslims, who are illegal immigrants from Myanmar, has been taken keeping in mind national security threats, the Centre told the Supreme Court on Monday through an affidavit.

Singhvi said: "We beseech the government with all earnestness and humility to not use blanket approaches as we are given to understand that the affidavit submitted in the Supreme court suggests that the government of India is not bound by any worldwide treaty".

Home Minister Rajnath Singh on 15 September said that the government would inform the Supreme Court on its stand on the Rohingya immigrants on 18 September.

The Centre also pointed out that Rohingyas had made an illegal entry into India and there was a foolproof system in place to ensure they could easily sneak into the country. Responding to a plea against deportation of Rohingyas from India, the Centre stated that the refugees from Myanmar posed threats to national security. "Once refugees are registered they are not to be returned back to the countries where they fear persecution", Farhan Haq said when asked about India sending Rohingyas back, reported IANS.

"The right to reside and settle in the country is available only to citizens and not to illegal immigrants", the government said, making it clear that India is not signatory to the United Nations convention on refugees and thus is not bound by it.

"But you can not say that merely because there are some inputs which suggest terrorist organizations are trying to radicalize them etcetera, therefore we will ignore human rights or rights under various worldwide conventions", he added.

The Centre has told the Supreme Court that many Rohingyas have acquired documents meant for Indian citizens only like Aadhaar, PAN and Voter-ID.

Their plea claims that deportation of the refugees would be in contradiction with the principle of "Non-Refoulement", recognised as a principle of Customary International law.

Their plea challenged the government's deportation plan on several grounds, including violation of worldwide human rights conventions.

Highly critical of the government's plans to deport Rohingya Muslims, he said the Modi dispensation was hell bent to do so only due to their religion.

Thousands of Rohingyas have poured into Bangladesh - and some into India - after fleeing a military offensive in Myanmar's Rakhine state.

The bench, while asking the petitioner to reply, posted the matter for further hearing on October 3, and said the legal position, including the court's jurisdiction, would be examined on that day.
