Police: Homeowner shoots, kills intruder in Mason County

A Washington state man was charged with suspicion of second-degree murder after police said he fatally shot an intruder he caught showering inside his business.

The shooting victim was identified as Nathaniel Joseph Rosa, 31, of Bothell, according to Mason County Coroner Wes Stockwell.

He's been in custody at the Mason County Jail since his arrest and the sheriff's office has since referred the case to Mason County Prosecutors, which will decide whether to formally charge Fanning.

Investigators are questioning why Fanning wouldn't call police when he clearly had the time to do so before going back to his business. After noticing the door was kicked in, Fanning found Rosa in the shower and yelled at him to get off his property. The arrest has already led to some internet controversy, with many discussing whether a second-degree murder charge was appropriate.

While not citing any specific evidence, local law enforcement said there is "more to the story". It said that Fanning lived in an adjacent home.

Sheriff's Lieutenant Travis Adams says the man owns both properties and runs a business out of a building on the second property. Fanning is scheduled to be arraigned on the charge on April 10.

Todd Maybrown, a criminal defense lawyer in Washington, told the New York Times 'it's kind of the wild west out here, in a way'.

State law allows people to use their feelings of being threatened when deciding whether to use lethal force to defend themselves, but the danger must be imminent and threaten life or serious bodily injury.
